Barbados International Business Association website http://biba.bb is currently provided free-of-charge to users who agree to abide by the terms and conditions of this Agreement. The Association reserves the right to change the nature of this relationship at any time and to revise these Terms and Conditions from time to time as the Association sees fit. Users who violate the terms of this Agreement will have their access canceled and may permanently be banned from using the Site and any of its interactive services.

Users should check these terms and conditions periodically. By using the Site after we post changes to these Terms you agree to accept those changes, whether or not you actually reviewed them.

Using the Site will constitute your acceptance of these Terms. If you do not agree to abide by these terms, you should not use the site for any purpose. For the avoidance of doubt if you use the site you are bound by these Terms, whether or not you agree to abide by them.

This Site and all materials on the Site, including, but not limited to, images, illustrations, posts, audio clips and video clips (the "Materials") is the property of the Association  and/or its affiliates, licensors and credited authors and owners and are protected from unauthorized copying and dissemination by copyrights that are owned or licensed by the Association  or by the credited owners or authors and by copyright law, trademark law, international conventions and other intellectual property laws.  You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way whatsoever any Materials from The Site or any other website owned or operated by the Association without the prior written permission of the Association and/or the credited authors or owners. However, you may download or make one copy of the Materials and other downloadable items displayed on the Site, provided that the same are not used for any commercial purpose, distributed to third parties or offered for sale to third parties, and further provided that all copyright and other notices contained in the Materials are left intact. The Association is concerned about privacy matters for users of our website. We respect the privacy of every individual who visits our website or responds to our online communications or advertisements. We may ask you for information such as your name, address, telephone number and/or your e-mail address through our website, online communications or advertisements. From time to time you may also be asked whether you would like to provide additional information to be gathered by use of a "cookie" or similar file. TERMINATION

The Association may at its sole discretion and for any reason terminate or suspend your access to all or part of the Site including, but not limited to, any message boards on the Site. In the event this Agreement is terminated, the restrictions regarding Materials appearing on the Site, the representations and warranties, indemnities, and limitations of liabilities set forth in this Agreement will survive termination. In the event that you are unsatisfied with the services provided by the Association, your sole remedy is to terminate this Agreement.

JURISDICTION

The Association operates the Site from within Barbados. The Association makes no representations that content and materials on the Site are legal or appropriate for use outside Barbados. If you choose to access the Site from other locations, you do so at your own risk and are responsible for compliance with any and all local laws. You may not use the Site in violation of Barbados export laws and regulations. This Agreement will be governed by and construed in accordance with the laws of Barbados. Any claim or cause of action you have with respect to use of the Site must be commenced within one (1) year after the claim arises. If any provision of this Agreement is deemed void, unlawful, or otherwise unenforceable for any reason, that provision will be severed from this Agreement and the remaining provisions of this Agreement will remain in force. This Agreement constitutes the entire agreement between you and the Association concerning your use of the Site, and the Agreement will not be modified, except in writing, signed by both parties.

We welcome your feedback about the Site. Investing in Barbados

Non-national investors will need to submit an application for permission to invest in Barbados to the Exchange Control Authority (ECA). The functions of the ECA have been delegated to the Central Bank of Barbados and are carried out by the Foreign Exchange and Export Credits Department of the Bank.

The applications are usually submitted by the applicant or their professional advisor prior to the execution of the transaction contemplated, for permission "in principle". This permission is readily granted, especially if employment in Barbados will be created, but usually states that the permission is subject to the remittance to Barbados of foreign currency and that evidence of the remittance be submitted to the ECA. Once permission in principle is obtained the transaction is completed and evidence of the foreign remittance submitted to the ECA; the amount of foreign currency becomes registered with the ECA. The certificate of registration of these funds is an important document as it must be presented at any time in the future that the investment proceeds are to be repatriated from Barbados.

The investment vehicle or business in which the non-national has invested is treated as resident and all transactions in foreign currency will be subject to exchange control permission or guidelines under delegated authority to the commercial banks. In certain circumstances when a business earns foreign exchange a commercial bank may open a foreign currency account in Barbados for the business. The commercial bank is required to monitor the transactions on the account in accordance with the guidelines issued by the ECA from time to time and to submit information on the transactions.

Non-national investors or corporations controlled by non-nationals are generally required to finance their operations from sources external to Barbados. Where a significant project is being undertaken in Barbados that will create employment and foreign exchange earnings the ECA will consider applications for permission for financing arrangements that vary from the general requirement.
